2. Scope

These terms govern purchases made through the store. A “consumer” is a natural person acting outside their trade, business, craft or profession. Mandatory consumer rights prevail over any provision of these terms.

3. Products and compatibility

Essential characteristics, reference, options and price are shown on the product page. Images are illustrative when they represent a product family. The customer must check the bike’s model, year, capacity and system; MotoXtreme offers compatibility confirmation before purchase. Performance components should be installed and tuned by a qualified professional in accordance with the relevant instructions. This recommendation does not limit the statutory warranty or other consumer rights.

4. Contract and correction of errors

The customer selects the product and options, reviews the cart, supplies billing and delivery details, chooses delivery and payment and confirms using the “Order with obligation to pay” button. Before confirming, information can be corrected and products removed. The contract is concluded in Portuguese. Confirmation and a summary are sent by email and associated with the customer account where one exists.

5. Prices, taxes and payment

Consumer prices are in euros and include VAT at the applicable rate. Delivery charges and the final total are shown before confirmation. The currently available method is bank transfer. The order is processed after availability and payment are confirmed. In the event of an obvious price or description error, MotoXtreme will contact the customer before dispatch, allowing confirmation at the correct price or cancellation with a full refund.

6. Availability

Made-to-order references depend on supplier confirmation. Presence in the catalogue does not guarantee immediate stock. The contractual lead time will be communicated; where no other period is agreed, the applicable statutory maximum applies. If unavailable, the customer is informed and reimbursed without undue delay.

7. Delivery

The store is configured for Mainland Portugal delivery and free collection from MotoXtreme. The Azores, Madeira and other countries require prior confirmation of availability, transport, taxes and costs. Available options and prices appear at checkout.

8. Right of withdrawal

A consumer may generally withdraw within 14 days from physical receipt without giving a reason, by an unequivocal statement or the model form. Goods must then be returned within 14 days. Unless MotoXtreme made an error, the item is defective or otherwise stated before purchase, the consumer bears the direct return cost and is liable only for handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. A normal catalogue option or made-to-order reference is not automatically excluded; statutory exceptions apply only when their legal requirements are met. Refunds are made using the same means of payment, unless agreed otherwise, and may be withheld until the goods or proof of dispatch are received.

9. Statutory conformity warranty

New movable goods sold to consumers benefit from a three-year statutory conformity warranty under Portuguese law. Withdrawal and warranty are separate rights. Installation or use does not automatically remove the warranty, although incorrect installation, incompatible use or modification may be relevant when assessing whether the seller is responsible. Report an issue with the order number, description and, where possible, photographs to geral@motoxtreme.pt.

11. Personal data

12. Applicable law

Portuguese law applies, without depriving consumers of protection provided by applicable mandatory rules. Court references do not affect alternative dispute resolution rights or statutory territorial jurisdiction.

13. Professional customers (B2B)

Customers purchasing in the course of their trade, business, craft or profession contract as professional customers rather than consumers. A B2B account is subject to manual validation of the company and tax number and may be assigned a 0%, 10% or 20% commercial tier. The tier is personal, non-transferable and applied automatically after sign-in; prices and the final total are shown before confirmation.

Provisions of these terms specifically addressed to consumers, including the statutory withdrawal right and the consumer conformity regime, do not automatically apply to professional purchases. Rights arising from general law, the contract and any commercial warranty remain unaffected. Unless expressly stated otherwise, displayed prices include VAT. A future tier change does not alter previously confirmed orders.
